Welcome to Yanko (Pvt) Ltd. These Terms and Conditions (“Terms”) govern your access to and use of our travel and transportation platform, mobile application (“App”), and related services (collectively, “Services”). By accessing or using our Services, you agree to comply with and be bound by these Terms.
1. Acceptance of Terms
1.1. By downloading, installing, or using our App or Services, you agree to be bound by these Terms and our Privacy Policy. 1.2. If you do not agree with these Terms, you must not use the Services.
2. Eligibility
2.1. You must be at least 18 years old to use our Services. 2.2. By using the Services, you represent and warrant that you have the legal capacity to enter into a binding agreement.
3. Account Registration
3.1. To access certain features of the Services, you must create an account and provide accurate and complete information. 3.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. 3.3. Yanko reserves the right to suspend or terminate accounts for unauthorized use or violation of these Terms.
4. Use of Services
4.1. The Services are intended solely for personal, non-commercial use. 4.2. You agree to use the Services only for lawful purposes and in compliance with all applicable laws and regulations. 4.3. You must not use the Services to harm, harass, or defraud others.
5. Booking and Payment
5.1. You can book transportation services through the App. Pricing details will be displayed before booking confirmation. 5.2. Payment must be made through the methods provided in the App. Yanko does not guarantee the availability of all payment methods. 5.3. You are responsible for all charges associated with your booking, including cancellation fees, if applicable.
6. User Conduct
6.1. You agree not to:
- Violate any applicable laws or regulations.
- Use the Services to harm or endanger others.
- Impersonate another person or provide false information.
- Interfere with the operation of the App or Services.
6.2. Yanko reserves the right to suspend or terminate access to the Services for violation of these Terms.
7. Driver and Rider Responsibilities
7.1. Yanko acts as a platform connecting riders with drivers and does not operate or own any vehicles. 7.2. Drivers are responsible for ensuring that their vehicle is safe and compliant with all applicable regulations. 7.3. Riders are responsible for their personal belongings and must treat drivers and vehicles with respect.
8. Liability Disclaimer
8.1. Yanko provides the platform “as is” and disclaims all warranties, express or implied. 8.2. Yanko is not liable for any indirect, incidental, or consequential damages arising from the use of the Services. 8.3. Yanko is not responsible for disputes between drivers and riders.
9. Indemnification
You agree to indemnify and hold Yanko, its affiliates, employees, and agents harmless from any claims, liabilities, damages, or expenses arising out of your use of the Services or violation of these Terms.
10. Termination
10.1. Yanko may terminate or suspend your account at any time, with or without cause, and without notice. 10.2. You may terminate your account by deleting the App and ceasing all use of the Services.
11. Changes to Terms
Yanko reserves the right to modify these Terms at any time. Changes will be effective upon posting on the App or website. Continued use of the Services constitutes acceptance of the revised Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Sri Lanka. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
